Beta and Early Access Terms
These Beta and Early Access Terms govern any feature, service or version of the WorkMonitor Services that we identify as beta, preview, early access, experimental, pilot, "labs" or similar ("Beta Features"). They form part of the Platform Terms of Service, and capitalized terms have the meanings given there.
Beta Features exist so that we can learn how something works in real use before we commit to it. Using one is entirely optional.
What a Beta Feature is, and what it is not
1.1A Beta Feature is not a generally available part of the Services. It is offered for evaluation and feedback.
1.2Where a feature is described anywhere — in the product, in our documentation, on our website, in a sales conversation or in a proposal — as beta, in beta, preview, early access, experimental or in development, these terms apply to it, regardless of whether the word appeared next to it at the moment you enabled it.
1.3A statement that a feature is planned, on the roadmap, or coming is not a commitment to deliver it. You should not purchase, renew or budget on the basis of a feature that is not generally available. If a specific capability is essential to you, ask us to state it in an Order Form; if it is not in the Order Form, it is not promised.
No service level, no support, no warranty
2.1The Service Level Agreement does not apply to Beta Features. Their unavailability is not Downtime, and no service credit arises from it.
2.2The Support Policy does not apply to Beta Features. We may choose to help, and often will, but there is no response target and no obligation.
2.3BETA FEATURES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. The warranties in the Platform Terms of Service do not apply to them, and the disclaimers there apply to them in full.
2.4Our indemnity for intellectual-property claims does not extend to Beta Features.
2.5Our total aggregate liability arising out of or relating to a Beta Feature is limited as stated in the Limitation of liability section of the Platform Terms of Service, and where the Beta Feature was provided at no additional charge, that limit is one hundred US dollars (US$100).
They may change, break or disappear
3.1We may change, restrict, suspend, discontinue or withdraw a Beta Feature at any time, for any reason, with or without notice, and without liability.
3.2A Beta Feature may contain defects, may produce inaccurate results, may lose data, may perform poorly, and may be unavailable without warning. Its interface, its behaviour and its data model may change in ways that are not backwards compatible.
3.3We may delete data created by or held in a Beta Feature when the feature ends, and we may be unable to migrate it into a generally available feature. Export anything you would miss.
3.4A Beta Feature may never become generally available. If it does, it may do so on a different plan, at a price, or with different capabilities from the ones you evaluated.
Do not rely on a Beta Feature
4.1You must not use a Beta Feature for a purpose where failure, inaccuracy or unavailability would cause loss, harm or a breach of your own obligations.
4.2In particular, you must not rely on a Beta Feature as your record of a legal obligation, as evidence in a disciplinary or legal proceeding, as the basis for a payment to a person, as a compliance control you have told an auditor or a regulator that you operate, or as the sole source of a record you are required to keep.
4.3Where a Beta Feature produces a report, an export or an attestation, check it against the generally available parts of the Services before you act on it or hand it to anyone.
Data protection in a Beta Feature
5.1The Data Processing Addendum applies to Personal Data processed in a Beta Feature exactly as it applies elsewhere in the Services. Being in beta does not reduce our data-protection obligations, our security obligations, our breach-notification obligations, or your rights as controller.
5.2Where a Beta Feature would involve a new sub-processor, that sub-processor is added to the Sub-processor list with the same notice and objection rights as any other, before the feature is enabled for you.
5.3Where a Beta Feature would process a new category of Personal Data, or process it in a materially new way, we will describe that before you enable it, so that you can decide whether your own legal basis and notices cover it.
Feedback and confidentiality
6.1We may ask you for feedback about a Beta Feature. You are not obliged to give it. If you do, the feedback licence in the Platform Terms of Service applies: we may use it freely, without obligation or compensation.
6.2Unless we say otherwise in writing, the existence, functionality, performance and appearance of a Beta Feature that is not publicly announced is our Confidential Information. Do not publish screenshots, benchmarks or descriptions of an unannounced Beta Feature without our written consent.
6.3Where a Beta Feature is publicly announced, this confidentiality obligation does not apply to it.
Turning a Beta Feature off
7.1You may stop using a Beta Feature at any time, and an administrator can disable one for your organization where the Services provide a control for it. Ask us at support@workmonitor.ai if you cannot find the control.
7.2Stopping use of a Beta Feature does not affect the rest of your subscription and does not entitle you to a refund, because a Beta Feature is not part of what you paid for.
Where these terms sit
8.1If these Beta and Early Access Terms conflict with any other part of the Agreement in relation to a Beta Feature, these terms apply to that Beta Feature, except that the Data Processing Addendum continues to govern any conflict about the processing of Personal Data.
