Notice and proportionality

The Act on the Protection of Personal Information is built around purpose of use: it must be specified as far as possible, notified or publicly announced, and not exceeded without consent. For monitoring, the PPC's long-standing guidance expects the purpose to be stated in advance, a responsible person designated, the rules written down, and the operation checked. Work rules under the Labour Standards Act are the customary place to set monitoring expectations.

The instruments, and which control answers each duty

  • Act on the Protection of Personal Information: APPI, as amended. Purpose specification, notification or public announcement, restrictions on use beyond purpose, and data subject rights. Supervised by the PPC.
  • Labour Standards Act: Work rules (shūgyō kisoku). Employers with 10 or more employees must have work rules; monitoring expectations belong there.
